For the closure of Pond D, Dominion has proposed to excavate and move all CCR currently in Pond D to a newly constructed landfill located on the Possum Point facility property. Dominion has submitted a solid waste permit application to DEQ, but a permit has not yet been issued.
Possum Point Power Station is defined as a public facility in the Prince William County Zoning Ordinance. In March 2022, Dominion submitted a request to Prince William County’s Planning Office for a public facilities review determination for a proposed CCR landfill at Possum Point. Prince William County concluded that: "...the proposal does not substantially change the location, character, and extent of the Possum Point Power Station facility, and is exempted from the requirement for a [public facility review]."

In October 2022, Dominion submitted a solid waste permit Part A application to DEQ. DEQ provided technical review comments on the Part A application in December 2023 and received a response to the comments in March 2024. As a condition of obtaining a landfill permit, Dominion is working with Prince William County to offer and provide municipal water supply and residential service connections to properties not currently served that are within one mile of the proposed landfill (§ 10.1-1402.05). DEQ issued a conditional approval of the Part A application in May 2024.
Part A Processing Documentation:
Dominion submitted the solid waste permit Part B application to DEQ on December 27, 2024. DEQ issued a completeness review letter on January 31, 2025, stating the application appeared to be administratively incomplete. Dominion submitted a response with additional information on March 7, 2025, and DEQ issued a letter on April 4, 2025, stating that the Part B application appeared to be administratively complete and that DEQ would begin technical review. The permit process and status of this application can be tracked using the Permitting Enhancement and Evaluation Platform (PEEP) on the DEQ website using PEEP Request Number MAJ114. DEQ's goal for completing initial technical review of the Part B application is August 2025.

In addition to a solid waste permit, Dominion will need an updated VPDES permit to address industrial stormwater discharges from the power plant, Pond D dewatering, and CCR impacted stormwater from the planned landfill construction activities. Additionally, a Virgnia Water Protection (VWP) permit for wetland impacts due to the proposed landfill, and erosion and sediment (E&S) and stormwater construction general permit (SWCGP) from Prince William County will be required. DEQ is reviewing additional information related to a revised VPDES application for the reissuance of the existing discharge (water) permit.
