All facilities that generate solid waste must determine if their solid wastes are hazardous waste. Details concerning this determination process are outlined in 40 CFR § 262.11 of the federal hazardous waste regulations. Further, it is the responsibility of all business owners and other regulated entities to identify the types and quantities of hazardous waste potentially generated by their operations, and manage their hazardous wastes accordingly.

The amount of hazardous waste generated by a facility on a monthly basis establishes the facility’s generator status. Instructions for counting the types of hazardous wastes generated and determining a facility's generator status are provided at 40 CFR § 262.13 of the federal hazardous waste regulations. The main generator categories defined below.

Handlers of hazardous waste and used oil may also be subject to regulatory oversight.

Very Small Quantity Generator

A very small quantity generator (VSQG) is any generator that generates the following amounts of hazardous waste in a calendar month:

Less than 100 kilogram (220 pounds) of hazardous waste AND
Less than 1 kilogram (2.2 pounds or 1 quart) of acute hazardous waste.

VSQGs may never accumulate more than 1,000 kilograms (2,200 pounds) of hazardous waste (approximately five (5), 55-gallon drums) or 1 kilogram of acute hazardous waste (2.2 pounds or 1 quart) at any time. Exceeding this threshold will result in the VSQG having to comply with large quantity generator (LQG) requirements for those accumulated hazardous wastes.

Small Quantity Generator

A Small Quantity Generator (SQG) is any generator who generates the following amounts of hazardous wastes in a calendar month:

Greater than 100 kilograms (220 pounds) but less than 1,000 (2200 pounds) of non-acute hazardous waste; AND
Less than or equal to 1 kilogram (2.2 pounds) of acute hazardous waste listed in 40 CFR § 261.31 or 40 CFR § 261.33 (e); AND
Less than or equal to 100 kilograms (220 pounds) of any residue or contaminated soil, water, or other debris resulting from the cleanup of a spill into or on any land, water, of any acute hazardous waste listed in 40 CFR § 261.31 or 40 CFR § 261.33 (e).

Large Quantity Generator

A large quantity generator (LQG) is any generator who generates the following amounts of hazardous wastes in any calendar month:

Greater than or equal to 1,000 kilograms (2,200 pounds) of non-acute hazardous waste; OR
Greater than 1 kilogram (2.2 pounds) of acute hazardous waste listed in 40 CFR § 261.31 or 40 CFR § 261.33 (e); OR
Greater than 100 kilograms (220 pounds) of any residue or contaminated soil, waste, or debris resulting from the cleanup of a spill, into or on any land or water, of any acute hazardous waste listed in 40 CFR § 261.31 or 40 CFR § 261.33 (e).
