What is Delivery Prohibition?

DEQ prohibits fuel deliveries to tank facilities that are not in compliance with the Underground Storage Tank (UST) regulations. Through the Delivery Prohibition process, DEQ may place Red Tags on those USTs that are in violation of the UST regulations. When DEQ places a red tag on a tank, fuel deliveries to the tagged tank are not allowed until the violations have been fixed. Tank owners who allow fuel deliveries to tagged tanks will be subject to DEQ enforcement action.

Before DEQ “red tags” a tank, DEQ notifies the UST owner and operator and invites them to a meeting to decide whether delivery prohibition is warranted. DEQ staff present the case to an agency decision maker, and the tank owner and operator are given the chance to demonstrate that their tanks are in compliance with the regulation. The agency decision maker then decides whether to issue the red tags. 

What do fuel deliverers need to do?

Fuel delivery companies cannot deliver fuel to a UST in Virginia that has a red tag on its fill cap or port. Delivering fuel to a tank that has been red tagged is a violation of the UST Regulation and could subject the fuel delivery company to enforcement action.
