Compliance is a system to make sure permittees and other members of the public are aware of and take steps to follow the State Water Control Law (§ 62.1-44.15:21 and § 62.1-44.15:20), the Virginia Water Protection (VWP) Permit Program Regulation (9 VAC 25-210), and the associated general permit regulations.

Compliance ensures that VWP permit conditions are followed, and serves as an essential link to DEQ’s enforcement program when serious violations occur.

DEQ monitors permit compliance by:

  • Reviewing required permit reports and submittals
  • Reviewing adherence to permit conditions
  • Inspecting project sites
  • Communicating and coordinating with permittees

DEQ uses compliance inspections to characterize:

  • Site conditions of construction and restoration sites
  • Compliance with permit conditions
  • Construction progress
  • Alleged noncompliance
  • Restoration site success

VWP also investigates reports of unpermitted activities in wetlands, streams or other state waters, and initiates enforcement actions if alleged violations of law or regulation are found.
