As announced in a June 29 press release and memo to stakeholders, DEQ is working with Professional Wetland Delineators to make its own State Surface Water Determinations for Virginia Water Protection permits. This will keep Virginia’s economy moving forward while providing certainty in light of the U.S. Supreme Court’s May 25 decision in Sackett v. U.S. Environmental Protection Agency.

Program Overview

DEQ issues Surface Water Withdrawal permits through the Virginia Water Protection (VWP) program. These permits regulate:

  • Surface water withdrawals and non-agricultural impoundments.
  • Impacts to surface waters, such as land clearing, dredging, filling, excavating, draining, or ditching in open water, streams and wetlands related to the construction of surface water withdrawal infrastructure.

Surface waters are defined as all waters that are not groundwater as defined in §62.1-255 of the Code of Virginia. A surface water withdrawal  is a removal or diversion of surface water from a stream, spring, lake, or pond in Virginia or from the Potomac River.

The Surface Water Withdrawal (SWW) permit program follows state regulations and federal guidelines under the Clean Water Act. State law requires that a VWP permit be obtained before withdrawing surface water or disturbing a wetland or stream by clearing, filling, excavating, draining or ditching. Applications are made through the Joint Permit Application process, which covers both federal and state review.
